SnapTrade Terms and Conditions

Welcome to SnapTrade. These Terms and Conditions ("Terms") govern your use of the SnapTrade mobile application ("App," "Service," or "SnapTrade"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Not Financial Advice — Important Disclaimer

THE APP AND ALL CONTENT, ANALYSIS, SIGNALS, SUGGESTIONS, AND OUTPUT PROVIDED BY SNAPTRADE ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING IN THE APP CONSTITUTES FINANCIAL, INVESTMENT, TAX, LEGAL, OR TRADING ADVICE.

SnapTrade is not a registered broker-dealer, investment adviser, or financial planner. We do not provide personalized recommendations to buy, sell, or hold any security or financial product.
All chart analysis, pattern recognition, trading signals (including entry/exit zones, stop loss, take profit), risk assessments, confidence scores, and any related explanations are generated by artificial intelligence for educational and informational use only. They are not recommendations or solicitations to trade.
You alone are responsible for your trading and investment decisions. You should never rely solely on the App when making financial decisions. Always do your own research and, where appropriate, consult a licensed financial, tax, or legal professional before acting.
Past performance, patterns, or historical analysis do not guarantee future results. Markets are volatile; trading and investing involve substantial risk of loss. You may lose some or all of your capital.

2. No Guarantee of Accuracy

The App uses AI (including third-party models such as Google Gemini) to analyze chart images and answer questions. AI can be wrong, incomplete, or outdated. We do not guarantee the accuracy, completeness, or timeliness of any analysis, pattern, signal, or chat response.
Chart analysis is based only on the image you provide. It does not have access to live data, your portfolio, or your personal circumstances. Do not treat any output as a substitute for professional advice or your own due diligence.

3. Acceptance and Eligibility

By using SnapTrade, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.
You must use the App in compliance with all applicable laws and regulations. You may not use the App for any illegal or unauthorized purpose.

4. Description of the Service

SnapTrade provides: Chart analysis — upload or capture images of trading charts to receive AI-generated analysis; Chat Assistant — ask the AI questions about trading concepts and your analysis. Features and availability may change. We do not guarantee uninterrupted or error-free service.

5. Subscriptions and Payments

Pro subscription: The App may offer a paid "Pro" subscription (e.g., weekly or yearly). Pricing and terms are displayed in the App and at the point of purchase.
Payment: Subscriptions are processed by Apple (App Store). You agree to Apple's payment terms and any applicable App Store terms. All fees are non-refundable except as required by law or as stated in Apple's policies.
Renewal and cancellation: Subscriptions may auto-renew unless you cancel before the renewal date. You can manage and cancel in your Apple ID subscription settings or in-app where provided.
Refunds: Refund requests are handled in accordance with Apple's refund policy.

6. Acceptable Use

You agree not to: use the App in any way that violates applicable law or the rights of others; attempt to reverse-engineer, decompile, or extract the App's source code (except as permitted by law); use the App to distribute malware, spam, or harmful content; resell, sublicense, or commercially exploit the App or its output in a manner that competes with or undermines the Service; rely on the App as your sole basis for making real-money trading or investment decisions without independent verification and, where appropriate, professional advice. We may suspend or terminate your access if we believe you have violated these Terms.

7. Intellectual Property

The App, including its design, code, text, graphics, and layout, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use in accordance with these Terms. You retain ownership of content you create (e.g., your chat input). You grant us the rights necessary to operate the Service (e.g., to send your chart images and messages to our AI providers as described in our Privacy Policy).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP AND ALL CONTENT AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or trading losses, whether or not we were advised of the possibility of such damages.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS (), IF GREATER).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

You use the App and any analysis or signals at your own risk. We are not liable for any trading or investment losses you may incur.

9. Indemnification

You agree to indemnify, defend, and hold harmless SnapTrade and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App, (b) your violation of these Terms or any law, or (c) your violation of any third party's rights.

10. Third-Party Services

The App uses third-party services (e.g., Google Gemini, Superwall, Apple) for AI, paywalls, and payments. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for their performance, content, or policies.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the App, you consent to the practices described there.

12. Changes to the Terms or the App

We may modify these Terms from time to time. We will indicate changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App.
We may change, suspend, or discontinue features of the App at any time without liability to you.

13. General

Governing law: These Terms shall be governed by the laws of the United States and the State of California, without regard to conflict of law principles.
Disputes: Any dispute arising out of these Terms or the App shall be resolved in the courts of competent jurisdiction, and you consent to personal jurisdiction in the United States.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
Entire agreement: These Terms, together with the Privacy Policy and any in-app purchase terms, constitute the entire agreement between you and SnapTrade regarding the App.
No waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
